DMCA Policy

Overview

ADVNCE respects the intellectual property rights of others and expects users of the Service to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond expeditiously to claims of copyright infringement that are reported to our designated copyright agent.

Reporting Copyright Infringement

If you believe that content available on or through the ADVNCE platform infringes your copyright, you may submit a notification ("DMCA Notice") to our designated agent. Your DMCA Notice must include all of the following:

  • A physical or electronic signature of a person authorized to act on behalf of the copyright owner
  • Identification of the copyrighted work(s) claimed to have been infringed (or, if multiple works are covered by a single notification, a representative list)
  • Identification of the material that is claimed to be infringing or subject to infringing activity, and information reasonably sufficient for us to locate the material on the Service
  • Your contact information, including name, address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

We strongly recommend consulting with an attorney before filing a DMCA notice. Submitting a false or fraudulent DMCA notice may result in liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

Counter-Notification

If you believe that material you submitted to the Service was removed or disabled by mistake or misidentification, you may file a counter-notification. A valid counter-notification must include:

  • Your physical or electronic signature
  • Identification of the material that has been removed or disabled and the location where it appeared before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or Los Angeles County, California if outside the United States), and that you will accept service of process from the person who filed the original DMCA notice

Repeat Infringer Policy

ADVNCE maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. We may also, at our sole discretion, limit access to the Service for users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

Limitation on Liability for Copyright Infringement

ADVNCE qualifies for the safe harbor provisions of the DMCA (17 U.S.C. § 512) as a service provider. We store user-submitted content at the direction of our users and are not responsible for the content users choose to submit. We respond to valid DMCA notices and act expeditiously to remove or disable access to infringing content upon receipt of a valid notification.

User Content and Copyright

By submitting content to the Service (including artist information, contract templates, images, and other materials), you represent and warrant that:

  • You own the copyright in the submitted content, or have obtained all necessary permissions and licenses
  • Your submission does not infringe the intellectual property rights, privacy rights, or any other rights of any third party
  • You have the full right, power, and authority to grant the licenses described in our Terms of Service

Changes to This Policy

We reserve the right to modify this DMCA Policy at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service constitutes acceptance of any changes.
